General Terms and Conditions of Sale

The following General Terms and Conditions of Sale together with the documents referred to below, including the Privacy Policy and General Terms and Conditions of Use) govern the offer and sale of project donations on our website, “almustafatrust.org.au” (and related Australian domains). Please read these terms and conditions carefully before making any donations. You should understand that by making a project donation, you agree to be bound by these terms and conditions.

The project donations made on this website are paid directly by AL MUSTAFA AUSTRALIA LIMITED (ABN 77 677 606 076). AL MUSTAFA AUSTRALIA LIMITED has its registered office in L 1 60 Martin Pl, Sydney NSW, 2000, Australia. AL MUSTAFA AUSTRALIA LIMITED is exempt from tax on most forms of income and capital gains as we have charitable status.

1. Our Business Policy

1.1 AL MUSTAFA AUSTRALIA LIMITED offers projects and appeals that users can donate on the website and its e-commerce business services are available exclusively to its end users, i.e. the “Donors”.

1.2 “Donors” shall mean any individual who is acting for purposes on helping making financial donations to one or more of our humanitarian projects to help people who are less fortunate, disabled, orphan or suffering from civil war or global disaster etc. If you are not a Donor, please do not make a donation.

1.3 The charity reserves the right not to process orders received from users who are not “Donors” and any other order which does not comply with AL MUSTAFA AUSTRALIA LIMITED business policy.

1.4 These General Terms and Conditions of Sale (together with the documents referred to herein) regulate the offer, transmission and acceptance of donation orders relating to projects or appeals between the users and AL MUSTAFA AUSTRALIA LIMITED.

2. How to Execute a Contract with AL MUSTAFA AUSTRALIA LIMITED

2.1 To place an order for the purchase of one or more products, you must add the products to the shopping basket then go to checkout to complete the order by following the relevant instructions.

2.2 The order form contains a link to these General Terms and Conditions of Sale, and also contains information on the main characteristics of each project donation ordered and the relevant donation price, the type of payment that you may use in order to purchase each project donation and references to the terms and conditions for cancelling project or appeal donations.

2.3 An order shall be deemed submitted when AL MUSTAFA AUSTRALIA LIMITED receives your project order form electronically and the order information has been verified as correct.

2.4 Before submitting your order form for the purchase of project donations, you will be asked to carefully read the General Terms and Conditions of Sale.

2.5 The order form will be filed in our database for the time required to process your order and as provided by law.

2.6 Before submitting the order form, you will be asked to identify and correct possible input errors.

2.7 The submission of orders to AL MUSTAFA AUSTRALIA LIMITED must be in English.

2.8 After your order form has been submitted, AL MUSTAFA AUSTRALIA LIMITED will process your order.

2.9 AL MUSTAFA AUSTRALIA LIMITED may not process purchases when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or the projects are no longer available. In the above cases, we shall inform you by e-mail that the contract has not been executed. If the projects or appeals displayed are no longer available at the time of your last access or once AL MUSTAFA AUSTRALIA LIMITED has received your order form, AL MUSTAFA AUSTRALIA LIMITED shall inform you of the unavailability of the projects or appeals within thirty (30) days from the day after AL MUSTAFA AUSTRALIA LIMITED has received your order.

If the order form has been sent and the price has been paid for projects or appeals that are no longer available, AL MUSTAFA AUSTRALIA LIMITED will refund the amount paid for those donated items.

2.10 By submitting an order form to AL MUSTAFA AUSTRALIA LIMITED, you unconditionally accept and undertake to observe the provisions of these General Terms and Conditions of Sale in your contract with AL MUSTAFA AUSTRALIA LIMITED.

2.11 By submitting an order form, you agree and accept these General Terms and Conditions of Sale as well as further conditions contained on the website, through links, including the General Terms and Conditions of Use and Cookies & Privacy Policy.

2.12 Upon submission of an order form, AL MUSTAFA AUSTRALIA LIMITED shall send you a donation purchase order receipt e-mail, containing a summary of the information related to the order form.

3. Guarantees and Project or Appeals Price Indication

3.1 We offer humanitarian projects and appeals products for donation purposes. These products are carried out by Al-Mustafa Welfare Trust International ® Ltd directly as well as its sister company in Pakistan, Al-Mustafa Welfare Society® and third party NGO’s around the third world. Our work is maintained to high standards of governance and we adhere to strict and stringent control.

3.2 AL MUSTAFA AUSTRALIA LIMITED does not offer fake appeals or projects. We provide evidence of all our projects and appeals that we collect donations for on our website.

3.3 The main characteristics of projects and appeals are shown on the website on each product page. The product images used are for illustrative purposes but the project details and price are accurate.

3.4 Project or Appeal Prices are subject to change and will be as quoted on our site from time to time, except in cases of obvious error. Check the final price before sending the relevant order form.

4. Payments

4.1 Payment of the project or appeals prices must be made by using one of the procedures indicated on the order form.

4.2 In case of payment by credit/debit card, all details (for example, card number or expiration date) will be sent by encrypted protocol to the payment processor (e.g., Stripe, PayPal). Such credit card details are not stored by us. If we need to issue a refund we will do it directly via the payment processor where your payment amount will be shown but none of your credit card details are accessible.

6. Donation Rights and Refunds

6.1 If you are a Donor, changes to your donation (such as cancellation) can be made in limited circumstances. Please contact us immediately if you have made a mistake.

7. Refund Procedures

Refunding donations is governed by the Australian Consumer Law, the Charitable Fundraising Act 1991 (NSW), and our internal policies. Generally, refunds can only be issued if the donation has been made in error (e.g. duplicate transaction). If there has been an administrative error when processing the donation then we can issue a refund if you notify us within 14 days via email at [email protected]

7.1 If the recipient of the project or appeal donation indicated in the order form is different from the individual who made the payment for such a donation, the amount paid shall be refunded by AL MUSTAFA AUSTRALIA LIMITED to the individual who made the payment.

7.2 We will usually refund any money received from you using the same method originally used by you to pay for the purchase.

7.3 AL MUSTAFA AUSTRALIA LIMITED shall not be responsible for any delay that is beyond its control including for delays caused by the method of purchase or refund, including by way of example: delay caused by credit card/debit card companies refund policies.

8.2 You are advised to read, if you haven’t already done so, our General Terms and Conditions of Use which also contain important information on how we process the personal data of our users and on the security systems of the website.

9. Governing Law

9.1 These General Terms and Conditions of Sale are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of that State.

9.2 AL MUSTAFA AUSTRALIA LIMITED holds an authority to fundraise under the Charitable Fundraising Act 1991 (NSW).

10. Amendments and updates

10.1 The General Terms and Conditions of Sale may be amended from time to time due to new laws and regulations or other reasons. The new General Terms and Conditions of Sale shall be effective as of the date of publication on the website.

11. Partner Charity Policy

11.1 Our board is legally responsible for all projects awarded by the Charity to partners and have policy in place to ensure compliance with legal duties and regulations issued by the ACNC (Australian Charities and Not-for-profits Commission), including the ACNC External Conduct Standards. We also comply with the ATO requirements, and regulations in other jurisdictions where we operate. We ensure that we follow a comprehensive end to end process of accountability and transparency relating to its use of funds. We hold a duty to undertake an assessment of all potential partners, ensure project proposals and agreements are in place, documenting end use of funds and monitoring the correct use of funds and project outputs. We approach this through ensuring partner Credibility, Scrutiny and Oversight.

We carry out appropriate checks on all potential or current partners to reduce the risk of fund mismanagement, ensure the partner is capable of delivering the specific project or projects and assure the funds provided are protected and used in the correct way for the intended purpose. Checks may include some or all of the following:

  • Whether the organisation is genuine, reliable and competent to carry out the activity being funded
  • Whether the organisation is culturally suitable for The Charity to work with and fund and whether there is a strategic ‘mission fit’ or match between the partnering organisation’s aims and The Charity’s purposes and interests
  • Steps to monitor, check and confirm that the funds granted have been properly used in line with intended purposes
  • Steps to check any exposure to risks such as fraud, financial crime, extremism or terrorism have been identified and managed. We ensure that directors, trustees, officers, employees and volunteers are not, and nor do they appear on, any list of individuals or organisations identified as associated with terrorism or designated by the United States Government Office of Foreign Assets Control (OFAC), the United Nations Security Council’s Sanctions Committee (UNSCSC), the European Union, or Australia.
  • That In all circumstances awarding a grant will always be in the best interests of The Charity
  • Its governance and constitutional form
  • The full scope of its operations and any conflicts with The Charity’s purposes, activities, funding or other interests
  • The organisations ability to demonstrate its delivery capacity and that it applies and is compliant with sector standards, norms and best practices or is working towards the relevant standards
  • Where the organisation is partnered with another Australian registered charity, the Australian partner is preferred to further satisfy due diligence requirements.

12. Safeguarding Children Policy

12.1 This policy applies to all staff, including senior managers and the board of directors, paid staff, volunteers and sessional workers, agency staff, students or anyone working on behalf of AL MUSTAFA AUSTRALIA LIMITED.

The purpose of this policy is:

  • to protect children and young people who receive The Charity's services. This includes the children of adults who use our services
  • to provide staff and volunteers with the overarching principles that guide our approach to safeguarding

AL MUSTAFA AUSTRALIA LIMITED believes that a child or young person should never experience abuse of any kind. We have a responsibility to promote the welfare of all children and young people and to keep them safe. We are committed to practice in a way that protects them.
